Why New Vape Laws & Tax Incentivise Disposables

Our new government has today announced the details of their Budget, which lays out how the next few years will look for us financially. It has been a long-awaited and much-anticipated event and will shape the country’s economic landscape.


It comes with lots of changes - £40bn in additional taxes, more money for the NHS, a freeze on fuel prices etc. - but most importantly for us, it comes with updates on how vaping will be affected.


After keeping on top of all news regarding vaping and e-liquids, and we’re unsurprised to hear that they’ve been included in Labour’s first Budget.


We’ve all been expecting to hear that there will be higher tax rates on e-liquids, but the new Budget has taken one step further.


We at DarkStar find ourselves asking why these new measures seem to be incentivising disposable vapes? Not the exact ones we see currently, but it doesn't take a lot of imagination to realise that adding a USB port to re-charge, and a rubber bunged hole to re-fill. gives essentially the same product, at a very marginally higher unit cost. Yes, the product will have the ability to be used multiple times, but in practice, it will likely be used much as it was before...


Let’s look at the facts:


Vaping duty will be introduced at £2.20 per 10ml of e-liquid, regardless of nicotine content.


The 2ml of liquid in modified disposables will be taxed at £0.44. This brings the retail price up from £4-5 to £4.44-5.44. This is in stark contrast to the sky-high tax rate for Short Fills which, at a staggering £26.40 tax rate, will bring Short Fills up to nearly £40 at retail. This will turn smokers away from using DIY e-liquids as a tool in their journey to quitting.


Despite the government having announced that the total ban of disposables will come into effect next year, this new tax guideline seems to reverse any good they were hoping to do.


Modified disposables being available on the market. and taxed at a lower rate per unit of nicotine than DIY alternatives, means they will still be more appealing to children and teenagers due to the simplicity and low cost, along with availability in the same unscrupulous local shops.


We have to ask why these new laws and taxes are being put in place? Why does the government seem set against those who have turned to DIY vaping to help them quit a smoking addiction?


We could support a ban on disposables - we’ve never sold one. But we’re very passionate about the instrumental and crucial role that DIY vaping can play in helping people to quit smoking. This new government policy seems to not have taken that into account.

So they want all people who vape to stop & start smoking again or buy blackmarket stuff, because they are losing so much money from people giving up smoking,typical…What a mare.

I am a cancer nurse and I’ve nurse 100s of lung cancer patients suffering horrendously on their death beds… i gave up smoking 10 years ago switching to making my own vape juice and incrementally lowering the nicotine content so I wouldn’t get any withdrawal symptoms. Although I’m not quite at 0mg nicotine, my lungs have never felt better, and I can see a path of being nicotine free in the near future. I am appalled that I am still classed as a smoker, bother financially and also when it comes to designated areas despite it still being legal to vape indoors in most settings. I must reiterate vaping is not risk free but I have yet to find evidence of passive vaping, and I believe the current risk of harm stands at 95% safer than cigarette smoking, please correct me if I am wrong. Anyway, seeing as vaping has far been the most successful way me and people I know have quit cigarettes, I am actually disgusted by this government’s stupidity in treating it with the same rules and tax. Grrrrr

I remember a similar panic when the TPD came in. this feels even meaner than the TPD. Especially considering the hurt in everyone’s pocket already. Let’s just whack 50 quid on everyone’s bill for having the audacity to want to quit a addiction.

Frustrating. And not like it will stop anything. Darren in the comments makes a fantastic arguement. And I agree with him. It won’t stop things. Heck. They can’t stop kids getting cocaine and cannabis. This will just screw over people who play by the rules and have no effect on youth vaping cos ‘bossman’ doesn’t tend to care so long as he gets his 6.99 for a elf bar (though I can’t comment, back in the day I boygbt singles for 5p)bjt that just proves the point further. Didn’t work in the 90s. Won’t work now.

Cash grab nothing more nothing less to pay for god knows what as they won’t disclose the costs of small boats.
They had existing powers called trading standards to go after the rouge retailers selling to kids and teens illegally
They failed to use such laws to stop it in a deliberate way to hammer everyone who was abiding by the law.

Disgusting behavior from them.
These rogue retailers won’t stop. They make way too much money off them, and fines for those caught are too small. They gave them until next year to sell off stocks.

Without a thought for UK manufacturers of E juices.

That’s easy for them to make up any losses with the stock they have hidden. How are pound shops allowed to sell them in the first place?

They deliberately cut off any protest or petitions then never opened up a new one until X was appointed to allow your protests online government petitions to gain support
With no date on when you can now start a new one.

This last government did this in July with the election

we are nearly in November, and still, no one has been appointed because they don’t want your legal objections as your right as a British citizen.

They happily took bribes for new clothes from lord Alli
Undeclared rent on 18 million homes our new PM got to stay in that should have cost over 2k a week in rent
but claim it was 2k for six weeks this government
Needs to be put out to pasture.
It is already been caught lying like the last one.

Those who prepared for the 2016 TDP knew this was coming.
I had stocked up on all sorts.
But will require moving flavors to keep me going

Cannot agree more on the artical you have writen, my worry is that there doing this because they cant get a grip hold on vaping unlike with tobbacco, people will just look at vaping in a few year and think there no point trying to quit the incentive isnt there the cost will be astronimical, but if they still have people smoking why get the tax from that,..

It feels very RE-active; instead of PRO-active -much like a lot of policy making.
I hadn’t even considered that “disposables” could be so easily modified to bypass the ban & continued to be used in such a similar way.

Apart from 10ml bottles there have been no detail released yet so let’s not guess.
10ml bottles are more likely to be bought by children and young adults and that is what they are targeting so let’s wait and see how it affects bottle shots etc.

I totally agree what an absolute farce I could swear but better not I won’t stop till I want to I’ll stop when I’m ready I know that you’re a buisness and the changes you have to make are not easy and take time I will use for as long as I can. Its plain and simple… its easy money for the government and will help in the downfall of the taxes they received from stinky fags… 5 years ago they got over £8 a pack….
Sales in base liquid and flavour shots should increase.. must be a loophole somewhere
